This document (along with other documents referenced herein) regulates the conditions under which this Website (classified-files.com) is operated and the purchase or acquisition of products and/or services on it (hereinafter, Conditions).
For the purposes of these Conditions, it is understood that the activity that Classified develops through this Website includes the marketing and distribution of apparel and accessories.
In addition to reading these Conditions, before accessing, browsing, and/or using this Website, the User must have read the Legal Notice and the General Conditions of Use, including the Privacy and Data Protection Policy of Classified. By using this Website or by making and/or requesting the purchase of a product and/or service through it, the User consents to be bound by these Conditions and all the aforementioned, so if they do not agree with all of it, they should not use this Website.
Furthermore, it is noted that these Conditions may be amended. The User is responsible for checking them each time they access, browse, and/or use the Website, as the applicable ones will be those in force at the time the purchase of products and/or services is made.
For any questions the User may have regarding these Conditions, they can contact the owner using the contact details provided above or, where applicable, through the contact form.
2. THE USER
Access, browsing, and use of the Website confer the condition of User (hereinafter referred to, interchangeably, as the User or Users), and from the moment browsing begins, all Conditions established herein, as well as their subsequent modifications, are accepted, without prejudice to the application of the corresponding mandatory legal regulations.
The User assumes responsibility for proper use of the Website. This responsibility extends to:
- Using this Website solely to make legally valid inquiries and purchases or acquisitions.
- Not making any false or fraudulent purchases. If it is reasonably considered that such a purchase has been made, it could be canceled, and appropriate authorities would be notified.
- Providing truthful and lawful contact details, such as email address, postal address, and/or other data (see Legal Notice and General Conditions of Use).
The User declares to be over 18 years old and to have the legal capacity to enter into contracts through this Website.
3. PURCHASE OR ACQUISITION PROCESS
Users can purchase on the Website through the methods and forms established. They must follow the online purchase process on classified-files.com, during which they can select and add various products and/or services to the cart or final purchase area, and finally click: “Complete Purchase.”
Additionally, the User must fill in and/or verify the information requested at each step. During the purchase process, before making the payment, it is possible to modify the purchase data.
Subsequently, the User will receive an email confirming that Classified has received their order or purchase request, i.e., confirmation of the order. If applicable, they will also be informed via email when their order is being shipped.
Once the purchase process is completed, the User consents that the Website generates an electronic invoice, which will be sent to the User via email. The User may also, if desired, obtain a paper copy of their invoice through the contact details provided above.
The User recognizes being aware, at the time of purchase, of certain specific sales conditions related to the product and/or service, which are shown alongside its presentation or image on their Website page, indicating, in a non-exhaustive manner, but according to each case: name, price, color, details of the products, or characteristics, the way the services will be carried out, and/or costs; and acknowledges that placing the order constitutes full and complete acceptance of the applicable specific sales conditions.
Communication, purchase orders, and payments involved in transactions carried out on the Website may be stored and retained in Classified’s electronic records to serve as proof of transactions, respecting reasonable security conditions and the relevant laws and regulations, particularly Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of individuals concerning the processing of personal data and the free movement of such data (GDPR), Law 3/2018, of December 5, on Data Protection and Guarantee of Digital Rights, as well as the rights of Users under this Website’s privacy policy.
4. AVAILABILITY
All purchase orders received by Classified through the Website are subject to product availability and/or
to any circumstances or force majeure (clause nine of these Conditions) that may affect the supply of goods and/or the provision of services. If difficulties arise with product supply or if products are out of stock, Classified commits to contacting the User and refunding any amount paid. This also applies if the service provision becomes unfeasible.
5. PRICES AND PAYMENT
The prices displayed on the Website are the final prices, expressed in Euros (€), and include taxes, unless applicable legal requirements specify otherwise, particularly concerning VAT.
Shipping costs are specified and included in the final prices of the products shown on the Website. Classified processes delivery and/or shipment through Packlink Shipping S.L. services.
The Website will not automatically add extra costs to the price of a product or service, only those that the User has voluntarily and freely selected.
Prices may change at any time, but such changes will not affect orders or purchases for which the User has already received a confirmation.
Accepted payment methods include: credit or debit card, and PayPal.
Credit card payments are subject to checks and authorizations by the issuing bank. If the bank does not authorize the payment, Classified will not be responsible for delays or non-delivery, nor will it enter into any contract with the User.
6. DELIVERY
Where applicable, physical delivery of the purchased item will take place within the following territory: Spain (Peninsula and Balearic Islands).
Except in cases of unforeseen or extraordinary circumstances or, if applicable, due to product customization, the order for the products listed in each purchase confirmation will be delivered within the period specified on the Website, according to the shipping method selected by the User, and in any case within a maximum of 30 calendar days from the date of order confirmation.
If, for any reason attributable to them, Classified cannot meet the delivery date, it will contact the User to inform them of this circumstance. The User may then choose to proceed with the purchase by setting a new delivery date or to cancel the order with a full refund. In any case, home deliveries are made on business days.
If delivery is impossible due to the absence of the User, the order may be returned to the warehouse. Nonetheless, the carrier will leave a notice explaining where the order is and how to re-arrange delivery.
If the User will not be present at the delivery location during the agreed time slot, they must contact Classified to arrange a new delivery day. If 30 days pass since the order was available for delivery, and it has not been delivered due to reasons not attributable to Classified, it will be understood that the User wishes to withdraw from the contract, and it will be considered terminated. As a result, all payments received will be refunded, except for extra costs incurred due to the User’s choice of a different delivery method other than the least expensive standard delivery offered on the Website; this will be done without undue delay and within a maximum of 14 calendar days from the date the contract is considered terminated.
Note that the cost of return shipment due to contract termination may be charged to the User.
For these Conditions, delivery will be deemed to have occurred when the User or a third party indicated by the User acquires physical possession of the products, proven by the signing of the delivery receipt at the agreed location.
The risks associated with the products pass to the User from delivery. The ownership of the products is transferred to the User upon full payment of the purchase price, including shipping costs, or at the time of delivery if it occurs after full receipt of the payment amount.
According to Law 37/1992, of December 28, on Value Added Tax (VAT), purchase orders for delivery and/or services are deemed to be located within the scope of Spanish VAT if the delivery address is in Spain, excluding Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one in force at the relevant time for the specific item.
7. TECHNICAL MEASURES TO CORRECT ERRORS
The User is informed that if they detect an error when entering data necessary to process their purchase request on the Website, they can modify these by contacting Classified through the contact spaces enabled on the Website, including customer service channels, or using the contact details provided in clause one (General Information).
Such information may also be corrected by the User through their personal login area on the Website.
In any case, the User has access to the shopping cart or basket, where their purchase requests are recorded, and can make modifications.
The User is also advised to consult the Legal Notice, Conditions of Use, and the Privacy Policy for more details on how to exercise their right to rectification as per Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons concerning the processing of personal data and data free movement (GDPR), and Law 3/2018, of December 5, on Data Protection and Guarantee of Digital Rights.
8. RETURNS
When the User acquires products on or through the Website of the owner, they are entitled to a series of rights, as listed and described below:
Right of Withdrawal
The User, as a consumer and user, makes a purchase on the Website and has the right to withdraw from this purchase within 14 calendar days without needing to justify.
This withdrawal period will expire after 14 calendar days from the day the User or a third party authorized by them, other than the carrier, acquires physical possession of the goods purchased on classified-files.com. If the goods forming the order are delivered separately, the period runs from the day the User or a third party authorized by them, other than the carrier, acquires physical possession of the last of these goods that were part of the same purchase order. In the case of service contracts, it begins from the day the contract was concluded.
To exercise this right of withdrawal, the User must notify Classified of their decision. They may do so via the contact spaces enabled on the Website.
Regardless of the method used, the User must clearly and unequivocally state their intention to withdraw from the purchase contract. They can also use the withdrawal form template provided by Classified as an annex to these Conditions, but its use is not mandatory.
To meet the withdrawal deadline, it suffices that the communication expressing the unequivocal decision to withdraw is sent before the period expires.
In the event of withdrawal, Classified will refund all payments received from the User, including shipping costs (except for additional costs chosen by the User for a different shipping method than the least expensive standard option offered on the Website), without undue delay and no later than 14 calendar days from when Classified is informed of the User’s decision to withdraw.
Refunds will be made using the same payment method the User employed for the initial transaction; this will incur no extra cost to the User. However, Classified may delay the refund until they have received the products or the User provides proof of return, whichever occurs first.
The User can return or send the products to: C/ Iriarte 7, 3rd Floor, 28028 Madrid, and must do so without undue delay and no later than 14 days from the date they informed Classified of their decision to withdraw.
The User acknowledges they will bear the direct cost of returning the goods (shipping, delivery), if applicable. They are also responsible for any reduction in value due to handling beyond what is necessary to establish the nature, characteristics, and proper functioning of the goods.
The User is aware that there are exceptions to the right of withdrawal, as detailed in article 103 of Royal Decree-Law 1/2007, of November 16, which approves the revised text of the General Law for Consumer and User Protection and other laws. These include, but are not limited to: personalized products; products that may deteriorate or expire quickly; CDs/DVDs of music or videos without their original sealed packaging, as sealed at the factory; products that, for hygiene or health reasons, are sealed and have been unsealed after delivery.
This same law applies to the provision of services that the User may contract via this Website, establishing that the right of withdrawal shall not apply when the service has been fully performed or started with the explicit consent of the consumer or user, who acknowledges they are aware that once the service has been fully completed by Classified, they lose their right of withdrawal.
Indeed, no refunds will be provided if the product has been used beyond mere opening, or if it is not in the original condition or has been damaged after delivery.
Products must also be returned using or including all original packaging, instructions, and any accompanying documents, along with a copy of the purchase invoice.
Return of defective products or errors in shipment
This applies to cases where the User considers that at the time of delivery, the product does not conform to what is stipulated in the contract or purchase order, and they must immediately contact Classified to report the discrepancy (defect/error) using the same means or contact details provided in the previous section (Right of Withdrawal).
The User will be informed about how to proceed with returning the products, and once returned, they will be examined. The User will be notified within a reasonable period whether a refund or exchange is appropriate. The refund or replacement will be processed as soon as possible and no later than 14 days from the date we send an email confirming that a refund or replacement is due.
The amount paid for products returned due to a defect—when such a defect exists—will be fully reimbursed, including delivery costs and any expenses incurred by the User for returning the product. The refund will be made using the same payment method employed for the initial purchase.
Always, the User’s rights under applicable current legislation will prevail, especially as a consumer and user.
Guarantees
The User, as a consumer and user, enjoys guarantees regarding products purchased
through this Website, in accordance with the legally established terms for each product type. Classified responds for any lack of conformity manifested within two years from the date of delivery of the product.
In this context, products are considered compliant with the contract if: they match the description provided by Classified and possess the qualities presented therein; are suitable for the uses normally associated with such products; and display the usual quality and performance expected of products of the same kind and which are fundamentally expected. When this is not the case with regard to the delivered products, the User must proceed as indicated in the section on Returning Defective Products or Errors in Shipment.
However, some products sold on the Website might present non-homogeneous characteristics depending on the type of material used in manufacturing, which form part of the product’s individual appearance and are not considered defects.
Additionally, it may happen that the User acquires a product from a brand or manufacturer provided by a third party. In such cases, and considering the product as defective, the User also has the option to contact the responsible brand or manufacturer directly to exercise their legal warranty rights within the two years following delivery, provided they have retained all relevant warranty information.
9. DISCLAIMER OF LIABILITY
Except where legally stipulated otherwise, Classified will not accept liability for the following losses, regardless of their origin:
- Any losses that are not attributable to any breach on its part;
- Business losses (including loss of profit, income, contracts, expected savings, data, goodwill, or unnecessary expenses incurred); or
- Any other indirect losses that were not reasonably foreseeable by both parties at the time the sales contract was made.
Classified also limits its liability regarding the following cases:
- While every effort is made to provide an accurate visual representation of products on the Website, it is not responsible for minor discrepancies or inaccuracies due to resolution issues, browser problems, or similar factors.
- Classified will act diligently to facilitate delivery through the responsible logistics company. Nonetheless, it is not liable for damages caused by transportation issues, including strikes, roadblocks, or other sector-specific delays that cause delays, losses, or theft of the products.
- Technical failures caused by fortuitous or other causes that hinder normal online service operation.
- Unavailability of the Website due to maintenance or other reasons, preventing access.
Classified employs all reasonable measures to ensure the purchase, payment, and delivery process runs smoothly; however, it disclaims liability for causes beyond its control, force majeure, or unforeseen circumstances.
It does not accept responsibility for misuse or wear and tear of products used by the User. Neither is it responsible for incorrect returns made by the User. The User bears the responsibility for returning the correct product.
In general, Classified is not responsible for breaches or delays in fulfilling obligations caused by events outside its reasonable control, which include but are not limited to:
- Strikes, employer closures, protests;
- Civil unrest, rebellion, invasion, terrorist threats or attacks, war (declared or not), or preparations for war;
- Fires, explosions, storms, floods, earthquakes, landslides, epidemics, or other natural disasters;
- Inability to use trains, ships, planes, motor vehicles, or other transportation means;
- Impossibility of using public or private telecommunications systems;
- Acts, decrees, legislation, regulations, or restrictions imposed by any government or public authority.
During force majeure events, obligations will be suspended for the duration of the cause, and Classified will have an extension equivalent to that period to fulfill the obligations. The company will make all reasonable efforts to find a solution that allows it to meet its commitments despite the force majeure.
10. WRITTEN COMMUNICATIONS AND NOTICES
By using this Website, the User agrees that most communications with Classified will be conducted electronically (via email or notices posted on the Website).
For contractual purposes, the User consents to use this electronic means of communication and acknowledges that all contracts, notices, information, and other communications sent by Classified electronically meet the legal requirements to be in writing. This condition does not affect rights recognized by law for the User.
The User may send notices or contact Classified through the contact details provided in these Conditions and, where applicable, through the contact forms on the Website.
Additionally, unless otherwise stipulated, Classified may contact and notify the User via their email address or postal address provided.
11. WAIVER
No waiver by Classified of a specific legal right or action, or failure by Classified to demand strict compliance by the User of any obligation, will constitute a waiver of other rights or actions arising from a contract or these Conditions. Nor will it exempt the User from fulfilling their obligations.
No waiver of any of these Conditions or of rights or actions derived from a contract will be valid unless explicitly stated as a waiver, formalized, and communicated to the User in writing.
12. NULLITY
If any of these Conditions are declared null and void by a final ruling from a competent authority, the remaining clauses will remain in force, unaffected by such declaration of nullity.
13. ENTIRE AGREEMENT
These Conditions, together with any document expressly referred to herein, constitute the entire agreement between the User and Classified regarding the object of the sale and replace any previous agreements, contracts, or promises, verbal or written, made by the same parties.
The User and Classified acknowledge having consented to the formation of a contract without relying on any statements or promises made by the other, except for what is expressly included in these Conditions.
14. DATA PROTECTION
Any personal information or data provided by the User to Classified during a transaction on the Website will be processed in accordance with the Privacy and Data Protection Policy. By accessing, browsing, and/or using the Website, the User consents to this processing and declares that all information provided is truthful.
15. APPLICABLE LEGISLATION AND JURISDICTION
Access, browsing, and/or use of this Website and the purchase contracts made through it will be governed by Spanish law.
Any dispute, issue, or disagreement arising or related to the access, use, or interpretation of these Conditions or the sales contracts between Classified and the User will be submitted to the non-exclusive jurisdiction of Spanish courts and tribunals.
16. COMPLAINTS AND CLAIMS
The User can submit complaints, claims, or any other comments to Classified via the contact details provided at the beginning of these Conditions (General Information).
Additionally, Classified has official complaint forms available to consumers and users, which can be requested at any time using the contact details provided above.
If a dispute arises from the contract between Classified and the User, the User, as a consumer, may request an out-of-court resolution of the controversy under Regulation (EU) 524/2013 of the European Parliament and of the Council, of May 21, 2013, on online dispute resolution in consumer matters and amending Regulation (EC) 2006/2004 and Directive 2009/22/EC, accessible via: https://ec.europa.eu/consumers/odr/.
